The Court has today (12, November, 2025), found that the evidence given from ballistics and post mortem shows that 4 protestors who died in Masimba, Kajiado County in June 2022 succumbed to gunshot wounds.
The Court, thus recommended that three police officers; PC. Hosea Chikara, PC. Mohammed Adan and PC. Wambua Kilonzo be charged with the offense of murder following the deaths of Duncan Kanari, Letemir Topoika, Dennis Matheka and Ntidu Tereu.
Further, the GSU officers will be charged with; excessive use of firearms, conspiracy to defeat justice, conspiracy to commit murder, conspiracy to commit a felony and an accessory after the fact. The Court recommended the file be forwarded to the ODPP.
The four were killed along the at Masimba Trading Centre Nairobi – Mombasa Highway as they demonstrated against the increasing cases of human-wildlife conflict. Six other demonstrators sustained serious injuries.
The Independent Policing Oversight Authority (IPOA) took up the matter on own motion pursuant to the provisions of Section 6 of IPOA Act, which allows the Authority to “investigate any complaints related to disciplinary or criminal offences committed by any member of the Service, whether on its own motion or on receipt of a complaint, and make recommendations to the relevant authorities, including recommendations for prosecution compensation, internal disciplinary action or any other appropriate relief.”
