Two police officers- an Inspector and a Corporal are today set to be charged with murder at the High Court in Nairobi over the death of a suspect.

Mr. Vitallis Owino Ochillo alias Baba Anita alias Waingo alias Madaraka died on May 3, 2020.

He succumbed to injuries sustained after he was arrested, allegedly for contravening curfew orders at around 19.00 Hrs on the material day, at Mradi area, Mathare North in Nairobi.

The Independent Policing Oversight Authority launched investigations into the death and cited two officers for murder.

They are Inspector Daniel Musau and Corporal Robert Mwangi Kibororo.

The officers were arrested yesterday, August 17, 2021 and placed in custody at Capitol Hill police station, Nairobi.

They are scheduled to take plea for murder at the High Court in Milimani, Nairobi.

The decsion to charge was made by Director of Public Prosecutions after independently reviweing the IPOA investigation file.

“Pursuant to Section 25 of IPOA Act which requires that deaths which are a result of police action or caused by members of the National Police Service while on duty be investigated, the Authority launched this investigation. IPOA remains committed to being independent, impartial and fair,” IPOA Chairperson Mrs. Anne Makori.

Senior Director of Public Prosecutions Tabitha Ouya said: “Having analysed the duplicate (IPOA) file we concur with reccomendations of the Authority and direct that the officers be arrested and jointly charged with the offence of murder contrary to Section 203 as read with Section 204 of the Penal Code.”
